By visiting this website and formulating requests for original paintings, limited edition prints and/or consultancy services provided or offered here, you unconditionally agree to the following Terms & Conditions. Please read them carefully. For the purposes of the Terms & Conditions outlined herein, You is defined as the visitor to the Christopher Andrew Art website, browsing and preceding to offering and actively engaging in purchase of art work and products or services from The Design Company trading as Christopher Andrew Art. We or "us" is Christopher Andrew Art ("CA Art"), a trading name of The Design Company, a partnership based in the UK and established in 1986, who will accept an offer to purchase goods and/or services, confirm the order, supply and subsequently arrange for delivery for said goods and/or consultancy services, upon receipt and clearance of payment in accordance with the Payment Terms detailed in the Order and/or Consultancy sections, as appropriate, of this website. Any orders placed by you with us must be placed in accordance with these Terms and Conditions. Registration You warrant that the personal information you must provide when registering as a customer or client on this website or by other method is true, accurate, current and complete in all respects. You agree not to impersonate any other person or entity or to use any false name or any other name that you are not authorised to use. You agree to accept full liability for costs and/or consequential losses which we incur should you provide false information or use a name that you are not authorised to use. You accept that any contract will be entered into by you under your real name. Security and Privacy Policy We employ industry standard measures to protect and ensure the confidentiality of your personal information. We will store all data on a secure server network and will ensure that all personal information will be kept confidential at all times, unless required to disclose it by law under the provisions of current or future Data Protection legislation. When you purchase from us via this website or otherwise, we will ask you to input and/or provide personal information such as your name, e-mail address, billing address, delivery address, telephone number, credit or debit card information and a password. We may use your information to process your order and to provide a service that meets our customer needs in all respects. As a matter of policy, we will not sell or rent any personally identifiable information about you to any third party. We use cookies to keep track of your current shopping session. We reserve the right at any time, in whole or any part thereof, to modify or withdraw, temporarily or permanently, the services offered via this website. Whilst fulfilling all obligations concerning prior received offers to purchase product, you confirm that we shall not be liable to you or any third party from such modification or withdrawal of services. Your continued use of this website following such change shall be deemed to be your acceptance of such change. Product purchase All orders made by you are subject to acceptance in accordance with our Order Acceptance policy as below. The following steps create a contract of obligation between you and The Design Company trading as Christopher Andrew Art. The steps required to create this contract are as follows: An order is placed for a product by your pressing of the submit button on the website at the end of the checkout process or, if that service is not available for any reason, by submitting your order request by e-mail or by facsimile transmission. We will send you an order acknowledgement by email or facsimile or letter by surface mail, as appropriate. This communication, howsoever sent to you, will formulate a confirmation of receipt of your order request and Order Processing acceptance by us. This communication will confirm the total amount and currency of your order as charged to your credit or debit card or to be paid in total by cheque or BACS transfer. For e-mail transmissions, we advise that you print and retain a copy of our e-mail as a record and receipt of your transaction for future reference. This is not an order confirmation or order acceptance by us. Once your bespoke order has been created, a despatch confirmation e-mail, letter or facsimile will be sent to you. If your order is not accepted, it may be due to one or more of the following reasons: 1 . The product
you ordered is temporarily withdrawn from sale or unavailable. Delivery We aim to ship original art and/or prints held and stocked in our gallery within a maximum of 14 days of receiving an order, save for bespoke framing orders and a two week period during August when our warehouse/distribution service is closed, unless a specific despatch date has been agreed by a partner of the company. Any agreement for an estimated delivery duration and/or specific delivery date must be in writing from us and signed by a partner. An offer to look into a possible despatch date and/or delivery date or a request by you in this respect will not constitute an agreement by us unless confirmed and agreed in writing. Bespoke framing will be subject to the availability of the frame requested by you at the time of your order and subject to our workload at the time of order. We will provide an estimated despatch date in accordance with the above paragraph. We aim to ensure that commissioned art, to your order, is commenced as soon as possible, usually within a period of 6 to 8 weeks from receipt of your initial payment and our order confirmation. This time scale will vary depending on the volume of orders pending at any given time and/or the personal circumstances of the artist at the time of order. However, an estimated delivery date for a commissioned painting will be agreed with you, in advance, in writing by us in accordance with the above paragraph and we will use our best endeavours to meet any such date. Time will not be of the essence of a contract under any circumstances unless specifically agreed in writing by a partner, in accordance with the conditions outlined above. Damaged or lost goods Art work ordered by you is fully insured by us during transit against damage or loss. All art work is carefully packaged for transit in the United Kingdom or world-wide. We will not be liable for consequential loss for nondelivery or late delivery or for damaged paintings or prints, as a result of the actions of our carrier. Damaged or lost goods will be replaced by us as soon as practicable and subject to the availability of prints and/or time scale for completing a replacement painting if appropriate. All damages must be reported in writing to us within 48 hours of delivery by e-mail, facimile or guaranteed delivery surface mail letter otherwise all goods will deemed to have been delivered in good condition. No late claims can be accepted for correspondence not received by us unless irrefutable proof of despatch can be provided to us upon request. No claims will be accepted for any damage howsoever incurred or caused by you or others when hanging a painting or picture. You agree to accept sole responsibility in this respect. Cancellation/Refund Policy We aim to provide you with the highest quality product. If you are not satisfied with your painting or print supplied to you from stock, you may return to us the item for replacement within 14 days from the date of delivery. To return an item, please send an e-mail to customerservices@ChrisAndrewArt.co.uk with your order number, name and address and reason for the return. We will endeavour to process the return and replacement within 14 days of receiving your returned item. We will notify you in writing once we have received and processed the returned item. The item must be in its original packaging and be undamaged. You are solely responsible for the shipping cost and for insurance in transit for any returned item unless it was delivered to you in damaged condition and signed for as such. We cannot accept responsibility for items returned but not received or if goods are not returned by secure means and proof of delivery obtained. Cancellation of your order cannot be accepted once we have accepted and processed the order and any unpaid amount will become due and payable in full. We can only replace commissioned art if it is faulty or damaged on delivery. No refunds can otherwise be provided for commissioned art.
Each painting or print purchased is sold subject to its product description, which sets out the specifications related to that product. We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time they were entered onto our database. Although we aim to keep the website as updated as possible, product descriptions appearing on this website at a particular time may not always exactly reflect the position at the time you place your order. We do not accept responsibility for the interpretation of individual colours, although we use our best endeavours to ensure that a painting or print is described as accurately as possible. Whilst every care has been taken to ensure the accuracy of product specification as displayed throughout this website, there are times where there may be slight colour variances between the settings on your own monitor and the true colour printing processes utilised. Payment, tax and duties All prices are subject to Value Added Tax (VAT) and are correct at the time of entering the information onto our database. The total cost of your order is the price of products ordered plus VAT plus delivery charges as stated upon the website. Goods despatched to bona fide businesses within the European Union (the "EU") and/or other countries outside of the EU may be supplied without VAT but only in accordance with the UK Customs and Excise regulations applicable at the date of invoice. For all orders received for shipment beyond the boundaries of the European Union; any applicable duties for the import of products into chosen countries from the UK are the responsibility of you, the ordering customer. Payment can be made by any of the methods specified in the payment section of this website. By placing an order, you confirm that the credit or debit card that is being used is your own, or is being used with full authorisation of the card holder. All credit and debit card holders will be subject to validation checks and authorisation by the card issuer. If the issuer of your card refuses to authorise payment to us we will not be able to process your order, nor will we be liable for any delay or nondelivery of product(s) as a result. Refusal of Transaction We reserve the right to withdraw any products from this website at any time. We may refuse to process any transaction for any reason or refuse service to you at our sole discretion.
